Private Road Obligation


What it means

In Japan, roads can be publicly owned (公道) or privately owned (私道). When a property's access road is a private road, the owners of the surrounding properties typically own a share of it. 私道負担 means part of the land you are buying is actually private road — land you own but cannot build on and must keep accessible to others.

Listings will often state something like 私道負担あり・○○㎡, meaning the property includes X square metres of private road land. The listed land area includes this portion, so the actual buildable area is smaller than it appears.

What to confirm before buying

  1. Exact area of the private road portion and how it is registered in the 公図.
  2. Who are the co-owners of the private road? Are there any disputes or uncontactable owners?
  3. Is there a written access and maintenance agreement (通行・掘削承諾書) in place?
  4. Has the private road been designated as a 42条2項道路 (building-standards road)? If so, setback may be required.
  5. What is the road's surface condition and when was it last repaired?
